Force majeure is the circumstance such as a natural disaster which is beyond the carrier’s or anyone’s control which can cause loss or damage (Bowersox, et al, 2023). When products are shipped, the carrier is liable for the product and is responsible for the safe and timely delivery of the products they are transporting. However, the carrier cannot be directly responsible for natural disasters or circumstances outside their control and therefore there is a legal exception for these circumstances. Force majeure is not just applicable to transportation, force majeure applies to any contract which circumstances outside the responsible party’s control prevent completion of a contract. In transportation, the bill of lading will define the carrier liability and responsibilities for possible causes of loss or damage except for force majeure which are beyond the carrier’s control (Bowersox, et al, 2023).
