If I were working at iHiker and the company received a complaint from an app user during a race and they lost due to it suddenly not working, I’d suggest using something called Alternative Dispute Resolution (ADR) instead of going to court. Asking for $100,000 is a lot, and the app did crash for about 10 minutes, a lawsuit is the last thing any company wants. There’s always a chance in that hurting the company’s image. We could start by negotiation. Both sides simply talking it out coming to an agreement would be the best solution in my opinion. Arbitration is another option. It’s definitely more like a court case but just a lot more private. A third person (an arbitrator) would listen to both sides and make a decision. The problem with this is that it’s more serious, and once a decision is made, both sides usually have to stick with it. I think mediation would probably be the best choice. That’s when a neutral third person (a mediator) helps both sides talk and figure out a fair solution. The difference between arbitration and mediation is the mediator doesn’t actually make the final decision. It’s done by the other parties. This way avoids bad publicity, save money, and maybe even fix the relationship with the customer. It’s also more private than court, which is good for the company. To make this happen, Miguel (our lawyer) would search for a reputable mediator who understands the issues at hand. During the meeting, both sides can talk and hopefully come to a deal. If they do, they can sign an agreement and move on. Overall, mediation is the smartest and most chill way to deal with this. It saves money, avoids drama, and helps protect iHiker’s reputation.
