Family, Faith, and the Law: Two Primary Sources from 1965–1971 Primary Source Analysis Worksheet

Read the excerpts below from two primary sources: the Moynihan Report (1965), Chapters III and IV only, and the Supreme Court’s per curiam decision in Clay v. United States (1971).

Answer all questions in complete sentences, using specific evidence from the texts to support your answers.

This worksheet is worth 40 points total: Part 1 (10 pts), Part 2 (10 pts), Part 3 — Comparison (10 pts), Part 4 — Reflection (10 pts).

Part 1: The Moynihan Report (1965)
The Moynihan Report, officially titled The Negro Family: The Case for National Action, was written by Assistant Secretary of Labor Daniel Patrick Moynihan. For this assignment, read only Chapter III (“The Roots of the Problem”) and Chapter IV (“The Tangle of Pathology”).

Excerpt A — Chapter III: The Roots of the Problem

“American slavery was profoundly different from, and in its lasting effects on individuals and their children, indescribably worse than, any recorded servitude, ancient or modern… the slaves were therefore reduced to the status of chattels — often, no doubt, well cared for, even privileged chattels, but chattels nevertheless.”

“Since many slaveowners neither fostered Christian marriage among their slave couples nor hesitated to separate them on the auction block, the slave household often developed a fatherless matrifocal (mother-centered) pattern.”

Excerpt B — Chapter IV: The Tangle of Pathology

“In essence, the Negro community has been forced into a matriarchal structure which, because it is so out of line with the rest of American society, seriously retards the progress of the group as a whole, and imposes a crushing burden on the Negro male and, in consequence, on a great many Negro women as well.”

“The only religious movement that appears to have enlisted a considerable number of lower class Negro males in Northern cities of late is that of the Black Muslims: a movement based on total rejection of white society… In a word: the tangle of pathology is tightening.”

Critical Thinking Questions — Part 1 (10 points)

1. According to Chapter III, how does Moynihan argue that American slavery differed from slavery as practiced in Brazil and other societies? Why does he believe this comparison matters? (3 pts)

2. In Chapter IV, what does Moynihan mean by describing the Negro family structure as “matriarchal,” and what problem does he claim this creates? (3 pts)

3. Moynihan cites the Black Muslim movement in Chapter IV as evidence of “alienation.” What does he suggest is drawing men to this movement, and what tone does he take toward it? (2 pts)

4. Identify one claim in these chapters that relies on interpretation or opinion rather than data. Explain your reasoning. (2 pts)

Part 2: Clay v. United States (1971)
Cassius Clay (Muhammad Ali) appealed his conviction for refusing induction into the armed forces after his local draft board denied his claim to conscientious objector status. The Supreme Court’s per curiam opinion, along with Justice Douglas’s concurrence, addressed both procedural and religious questions.

Excerpt A — Per Curiam Opinion

“Since the Appeal Board gave no reasons for its denial of the petitioner’s claim, there is absolutely no way of knowing upon which of the three grounds offered in the Department’s letter it relied. Yet the Government now acknowledges that two of those grounds were not valid.”

“This case, therefore, falls squarely within the four corners of this Court’s decision in Sicurella v. United States… the integrity of the Selective Service System demands, at least, that the Government not recommend illegal grounds.”

Excerpt B — Justice Douglas, Concurring

“What Clay’s testimony adds up to is that he believes only in war as sanctioned by the Koran, that is to say, a religious war against nonbelievers. All other wars are unjust… That is a matter of belief, of conscience, of religious principle.”

Critical Thinking Questions — Part 2 (10 points)

1. What were the three basic tests a registrant had to satisfy to qualify for conscientious objector status? (2 pts)

2. Why did the Supreme Court reverse Clay’s conviction? Was the reversal based on whether Clay’s religious beliefs were sincere, or on something else? Explain. (3 pts)

3. The Justice Department’s letter argued that Clay’s objections to war were “political and racial” rather than religious. What evidence from Clay’s own testimony (quoted in Justice Douglas’s concurrence) could be used to challenge that claim? (3 pts)

4. Why does the Court’s opinion rely on the earlier case Sicurella v. United States? What legal principle connects the two cases? (2 pts)

Part 3: Comparing the Sources
Both sources were produced within a few years of each other and both concern how American institutions — the federal government and the federal courts — viewed Black men, family, religion, and authority in the 1960s and early 1970s.

Comparison Questions (10 points)

1. The Moynihan Report treats the Black Muslim movement as a symptom of “alienation” and social breakdown. Clay v. United States treats Clay’s Nation of Islam beliefs as a sincere, constitutionally protected religious conviction. How do these two documents differ in how they portray the same religious movement? (4 pts)

2. Both documents were produced by federal institutions (the Department of Labor and the Supreme Court). What does each document assume about its authority to judge or classify the beliefs, families, or choices of Black Americans? (3 pts)

3. Which source relies more heavily on statistics and expert authority, and which relies more heavily on legal precedent and firsthand testimony? What are the strengths and limitations of each type of evidence? (3 pts)

Part 4: Reflection
Reflection Question (10 points)

1. Considering both sources together, what do they reveal about how the federal government and federal courts understood — or misunderstood — Black family life, religion, and identity in the mid-twentieth century? Use specific evidence from both texts to support your answer. (Write at least one full paragraph.) (10 pts)
